Terms of Service

1. Agreement to Terms

By registering for, accessing, or using ROASmind ("the Platform", "the Service") at roasmind.houseofnamus.com, you ("User", "you", "your") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

The Platform is operated by House of Namus, a sole proprietorship owned by Suman Debnath, registered in India ("we", "us", "our").

If you are using ROASmind on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, do not use the Platform.

2. Eligibility

To use ROASmind, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable law
  • Provide accurate and complete registration information

3. Description of Service

ROASmind is an AI-powered digital marketing platform that assists users in planning, executing, and optimising paid advertising campaigns on Meta (Facebook/Instagram), Google Ads, and LinkedIn. The Platform uses artificial intelligence to generate campaign strategies, ad copy, creative briefs, keyword recommendations, and performance optimisation suggestions.

ROASmind is a tool designed to assist and automate digital marketing tasks. It is not a licensed financial advisor, marketing agency, or legal advisor.

4. User Accounts

4.1 Account Registration

You must register an account to use the Platform. You agree to provide accurate, current, and complete information and to keep it updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You must not share your account with any third party. You are responsible for all activity that occurs under your account.

4.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

5. Subscriptions and Billing

5.1 Plans

ROASmind offers the following subscription plans:

  • Starter — ₹1,999/month
  • Growth — ₹9,999/month
  • Pro — ₹24,999/month
  • Enterprise — Custom pricing (contact defy@houseofnamus.com)

Plan features, limits, and pricing are as described on the pricing page and are subject to change with 30 days' notice.

5.2 Free Trial

New users are eligible for a 14-day free trial. No credit card is required to start the trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Platform.

5.3 Billing

Subscriptions are billed monthly in advance in Indian Rupees (INR) via Razorpay. By subscribing, you authorise us to charge your payment method on a recurring basis.

5.4 Refund Policy

All payments are non-refundable. We do not offer refunds for any subscription fees paid, including partial months, unused features, or periods during which the Service was available but not used.

You may cancel your subscription at any time. Cancellation stops future billing. You will retain access to the Platform until the end of your current billing period.

5.5 Price Changes

We reserve the right to change subscription prices with 30 days' prior notice. Continued use after a price change constitutes acceptance of the new price.

6. Acceptable Use

You agree to use ROASmind only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Platform to create, manage, or promote ads that violate Meta's, Google's, or LinkedIn's advertising policies
  • Use the Platform to conduct fraudulent, deceptive, or misleading advertising
  • Use the Platform to advertise illegal products or services
  • Attempt to reverse-engineer, copy, or replicate the Platform or its AI logic
  • Use automated scripts or bots to access the Platform beyond what is provided
  • Share your account credentials with third parties
  • Use the Platform to infringe any intellectual property rights
  • Upload malicious files, malware, or content intended to harm the Platform or its users
  • Attempt to gain unauthorised access to any part of the Platform or its infrastructure

7. Ad Platform Connections and Campaign Execution

7.1 OAuth Authorisation

By connecting your Meta, Google Ads, or LinkedIn account to ROASmind, you grant ROASmind permission to manage campaigns, ad sets, creatives, budgets, and retrieve performance data on your behalf, in accordance with each platform's terms of service.

7.2 User Responsibility for Ad Spend

You are solely responsible for all ad spend incurred on your connected ad accounts. ROASmind automates campaign management, but all advertising budgets are funded from and controlled by your own ad platform accounts. ROASmind never holds, processes, or is liable for your ad spend.

7.3 User Responsibility for Campaign Outcomes

ROASmind's AI engine is designed to optimise campaigns toward your stated goals. However, ROASmind does not guarantee any specific results, ROAS, conversion rates, lead volumes, or revenue outcomes. Digital advertising performance is subject to market conditions, platform algorithm changes, competition, seasonality, and other factors beyond our control.

You are responsible for monitoring your campaigns and ad spend at all times, even when using ROASmind's autonomous features. ROASmind may make errors in campaign setup, targeting, bidding, or optimisation. It is your responsibility to review, approve, and supervise all campaign activity.

House of Namus shall not be liable for any direct, indirect, incidental, or consequential loss arising from campaign performance, ad spend, or any action taken or not taken by ROASmind's AI engine on your behalf.

7.4 Platform Policy Compliance

You are responsible for ensuring that all campaigns executed through ROASmind comply with the advertising policies of Meta, Google, and LinkedIn. ROASmind will make reasonable efforts to avoid policy violations, but we cannot guarantee compliance in all cases, and you remain solely responsible for any policy violations, account suspensions, or penalties imposed by those platforms.

8. Intellectual Property

8.1 Our IP

ROASmind, its underlying AI systems, platform design, source code, and all proprietary algorithms are the intellectual property of House of Namus. Nothing in these Terms grants you any ownership of or licence to our intellectual property beyond the limited right to use the Platform as described herein.

8.2 Your IP

You retain full ownership of all content, brand assets, uploaded files, and business data you provide to ROASmind. By uploading content to the Platform, you grant House of Namus a limited, non-exclusive licence to use that content solely to provide the Service to you.

8.3 AI-Generated Content

Content generated by ROASmind's AI engine (ad copy, campaign plans, creative briefs, keyword lists, reports) is provided to you for your use. You are responsible for reviewing AI-generated content before publishing or acting on it.

9. Third-Party Services

ROASmind integrates with third-party services including Meta, Google, LinkedIn, Razorpay, Anthropic, OpenAI, Supabase, Vercel, Railway, and Resend. Your use of these services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or actions of any third-party service.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT GUARANTEE ANY SPECIFIC ADVERTISING RESULTS, ROAS, LEADS, REVENUE, OR RETURN ON AD SPEND.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOUSE OF NAMUS AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, OR LOSS OF AD SPEND, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless House of Namus and its owner, Suman Debnath, from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your advertising campaigns, ad content, or ad spend
  • Any violation of Meta's, Google's, or LinkedIn's advertising policies by campaigns executed through your account

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from or related to these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts in India.

We encourage you to contact us at defy@houseofnamus.com before initiating any legal proceedings, as we will make reasonable efforts to resolve disputes amicably.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last Updated" date and, for material changes, notify you by email at least 14 days in advance. Continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms.

15. Termination

15.1 By You

You may terminate your account at any time by cancelling your subscription and deleting your account from the Settings page. Termination does not entitle you to a refund.

15.2 By Us

We may suspend or terminate your account immediately and without notice if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Cause harm to other users or the Platform

Upon termination, your right to use the Platform ceases immediately. Your data will be deleted in accordance with our Privacy Policy.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and House of Namus regarding your use of ROASmind and supersede all prior agreements and understandings.
